Work Session #9 - 2007

A Work Session of the Whitpain Township Board of Supervisors was held on Tuesday, May 1, 2007 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA at 7:30 PM for the purpose of reviewing the agenda of the May 1, 2007 Supervisors' Meeting. Chairman Leigh P. Narducci was present with Supervisors Joseph J. Palmer, Brian W. Young, William L. McKernan III, and Anthony F. Greco. James Garrity, Esq. from the Township Solicitor's office, Township Manager Phyllis C. Lieberman, Assistant Township Manager/Township Engineer Roman M. Pronczak, Chief Mark A. Smith, Director of Finance M .Elizabeth McBride, Director of Public Works Ronald J. Cione, and Parks and Recreation Director Kurt W. Baker were also present. Director of Code Enforcement, Michael E. McAndrew and Fire Marshal David M. Camarda were absent. There were 3 residents present.

The Supervisors reviewed the agenda discussing approval of all expenditures on the April 2007 Voucher List, approval of the minutes of the April 17, 2007 Supervisors' Meeting, approval of an assignment of easement between Whitpain township and Robert Paul Trinkle and Kathy Lee Pape for the area adjacent to the roadbed on the southeasterly side of Morris and Cathcart Roads, approval of an amendment to a previously approved subdivision/land development plan for Deerfield Estates, authorization to approve final release of escrow for 599 Skippack Pike, consideration of a request from St. John's Lutheran Church for a waiver of a Building Permit fee for a Boy Scout/Eagle Scout project, and a request to allow the Centre Square Fire Company Ladies Auxiliary to place signs throughout the Township to advertise the May 5th indoor flea market.

Mrs. Lieberman noted that she had received several e-mails from a resident who wanted the Township to ban advertising flyers thrown on lawns. He said that when someone goes on vacation, accumulating flyers indicate that no one is home. Mrs. Lieberman told the gentleman that this matter had come up several years ago and that the Solicitor had determined that the Township couldn’t ban the practice. We agreed then that if a resident didn’t want the flyers, we the police or the Manager’s office would call the advertiser and ask them not to deliver them to that address. The gentleman was not satisfied with that, but Mr. Garrity agreed with Mr. Anderson that the Township should not enact such an ordinance.

Mr. Baker then addressed the Supervisors regarding walking trails in the Township and looking into connecting neighborhoods. The Supervisors agreed to pursue a planning grant for such a project and suggested that a subcommittee of the Open Space Committee be formed to work on this project. Mr. Narducci asked that the Board be given a breakdown on what our present trails cost to maintain.

Mr. Baker then stated that he and Chief Smith had been contacted by a resident of Blue Bell Country Club who is a film maker. He wants to film a movie he is producing in some of the Township parks. Mrs. Lieberman contacted DVIT and got a list of insurance he will need to provide and he is willing to comply. The movie is a coming of age movie about a young man who is starting to get in trouble, but is saved by the actions of his mother and girlfriend. The Supervisors agreed that if the insurance is provided, it would be fine to give him approval.

The Supervisors then left for the public meeting.

At approximately 8:10 PM the Work Session was reconvened.

The Supervisors then discussed three legal matters.

At approximately 9:00 PM the Work Session was adjourned.

The regular meeting of the Whitpain Township Board of Supervisors was held on Tuesday, May 1, 2007 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA. Supervisors Leigh P. Narducci, Joseph J. Palmer, Brian W. Young, Anthony F. Greco, and William L. McKernan III, were present. Township Manager Phyllis C. Lieberman, Assistant Township Solicitor, James Garrity, Township Engineer/Assistant Township Manager, Roman Pronczak, Director of Finance M. Elizabeth McBride, Police Chief Mark Smith, Director of Public Works, Ronald J. Cione, Park and Recreation Director, Kurt W. Baker, and Recording Secretary Michele Alifano were also present. Township Solicitor J. Peirce Anderson, Code Enforcement Officer Michael E. McAndrew, and Fire Marshal David M. Camarda were absent. There were approximately 10 members of the public in attendance.

Following the Pledge of Allegiance, Chairman Narducci called the meeting to order.

A motion was made by Mr. Palmer, duly seconded by Mr. McKernan, and unanimously passed to approve all expenditures on the April, 2007 voucher list.

A motion was made by Mr. Young, duly seconded by Mr. Greco, and unanimously passed to approve the minutes of the April 17, 2007 meeting.

A motion was made by Mr. Palmer, duly seconded by Mr. Greco, and unanimously passed to approve assignment of easement between Whitpain Township and Robert Paul Trinkle & Kathy Lee Pape for the area adjacent to the roadbed on the southeasterly side of Morris and Cathcart Roads.

A motion was made by Mr. Young, duly seconded by Mr. Greco, and unanimously passed to approve an amendment to a previously approved subdivision / land development plan for Deerfield Estates, located on the westerly side of Walton Road, north of Stenton Avenue. The subdivision / land development plan is titled "Deerfield Estates - 527 Stenton Avenue - Prepared for Philomeno & Salamone - Sheets 1 of 16 through 16 of 16", prepared by Robert E. Blue Associates, P.C., dated October 21, 2007 and last revised on April 16, 2007. Approval is conditioned upon resolution of all items listed in correspondence from the Engineering Department dated April 26, 2007 and receipt of all necessary permits from the Pennsylvania Department of Environmental Protection and Pennsylvania Department of Transportation.

A motion was made by Mr. Young, duly seconded by Mr. McKernan, and unanimously passed to authorize final release (Release #5) of all remaining escrow funds held for 599 Skippack Pike (LD-7-04).

A motion was made by Mr. Palmer, duly seconded by Mr. McKernan, and unanimously passed to waive the Building Permit fee for a Boy Scout/Eagle Scout project being conducted at St. John's Luthern Church, utilizing volunteer labor and donated materials.

A motion was made by Mr. Palmer, duly seconded by Mr. Greco, and unanimously passed to allow the Centre Square Fire Company Ladies Auxiliary to place signs throughout the Township from May 1st to May 10th to advertise the May 5th indoor flea market at the Centre Square Firehouse.

At this time, Vice Chairman Palmer asked if any member of the Board had any comments. There were none. Mr. Palmer then asked if any member of the audience wished to address the Board.

Mr. Bob Whittig asked for clarification as to when the next Board of Supervisors' meeting would be held. It was determined that due to Election Day coinciding with the regularly scheduled date for the meeting, the date would be changed to Monday, May 14th.

There being no further business to come before the Board, on motion made by Vice Chairman Palmer, the meeting was adjourned at 8:05 P.M.
