Work Session #5 - 2008 A Work Session of the Whitpain Township Board of Supervisors was held on Tuesday, March 4, 2008 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA at 7:30 PM for the purpose of reviewing the agenda of the March 4, 2008 Supervisors' Meeting. Chairman Joseph J. Palmer was present with Supervisors Brian W. Young, Anthony F. Greco, William L. McKernan III, and Adam D. Zucker. Township Solicitor James J. Garrity, Esq., Township Manager Phyllis C. Lieberman, Assistant Township Manager/Township Engineer Roman M. Pronczak, Director of Finance M. Elizabeth McBride, Police Chief Mark A. Smith, Director of Public Works Ronald J. Cione, Director of Code Enforcement Michael E. McAndrew, and Parks and Recreation Director Kurt W. Baker were also present. Fire Marshal David M. Camarda was absent. One reporter and two members of the public were also present. The Supervisors reviewed the agenda discussing approval of the minutes of the February 19, 2008 Supervisors' Meeting, approval of the February , 2008 Voucher List, approval of a request from Normandy Farms Estates to display a banner advertising several small bazaars over the next 18 months, authorization to allow Ambler-Whitpain Football/Cheerleading to place several signs advertising their registration, authorization for the Township to dispose of Township personal property by public auction for the calendar year 2008, utilizing JJ Kane Auctioneers or the on-line auction service of the Commonwealth of Pennsylvania, approval of a maintenance agreement between Hanover Hills, Inc. and Whitpain Township regarding financial security for maintenance of public improvements within the Hanover Hills Subdivision during the required maintenance period, release of final escrow for Hanover Hills, authorization for the Chairman and Secretary to sign on behalf the Township three Pillar Agreements, and adoption of Resolution 849 fixing all fees on the Township Fee Schedule. Mrs. Lieberman asked the Supervisors if the Flagpole Antenna photos sent by T-Mobile to be placed at the Community College was acceptable. They said it was not. Mr. Pronczak then gave a brief presentation to the Board about Reverse 911, which is a system for contacting members of the community in case of emergencies or when notice needs to be given. He noted that our Fire Marshal had advised that the County was investigating provision of the service Countywide. Mr. Baker then gave a presentation on the status of the Trails application to the County Open Space Board, noting that the County has extended the application period for one year. The Supervisors discussed a legal matter. The Supervisors then left for the public meeting. At approximately 8:20 PM the Work Session was reconvened. The Supervisors continued the legal matter discussion. At approximately 9:15 PM the Work Session was adjourned. Phyllis C. Lieberman #5 - 2008 The regular meeting of the Whitpain Township Board of Supervisors was held on Tuesday, March 4, 2008 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA. Supervisors Joseph J. Palmer, Brian W. Young, Anthony F. Greco, William L. McKernan, and Adam Zucker were present. Township Manager, Phyllis C. Lieberman, Township Engineer/Assistant Township Manager, Roman Pronczak, Township Solicitor, James J. Garrity, Director of Finance, M. Elizabeth McBride, Code Enforcement Officer, Michael E. McAndrew, Police Chief Mark A. Smith, Park and Recreation Director, Kurt W. Baker, Director of Public Works, Ronald J. Cione, and Recording Secretary, Michele Alifano were also present. Fire Marshal David M. Camarda was absent. There were approximately 4 members of the public in attendance. Following the Pledge of Allegiance, Chairman Palmer called the meeting to order. A motion was made by Mr. Zucker, duly seconded by Mr. Greco, and unanimously passed to approve the minutes of the February 19, 2008 Board of Supervisors' Meeting. A motion was made by Mr. Young, duly seconded by Mr. McKernan, and unanimously passed to approve all expenditures on the February, 2008 Voucher List, which totaled $808,858.30. A motion was made by Mr. McKernan, duly seconded by Mr. Greco, and unanimously passed to approve a request from Normandy Farms Estates to display a banner advertising several small bazaars over the next 18 months. A motion was made by Mr. Zucker, duly seconded by Mr. Greco, and unanimously passed to authorize Ambler-Whitpain Youth Football/Cheerleading Association to place 24" x 18"signs advertising their registration period which runs from April 1, 2008 to June 1, 2008. The signs will be posted from March 15 until May 17. A
motion was made by Mr. McKernan, duly seconded by Mr. Zucker, and unanimously
passed to authorize A motion was made by Mr. Young, duly seconded by Mr. Greco, and unanimously passed to approve a maintenance agreement between Hanover Hills, Inc. and Whitpain Township regarding financial security for maintnenance of public improvements within the Hanover Hills Subdivision during the required maintenance period. A motion was made by Mr. Greco, duly seconded by Mr. Young, and unanimously passed to release all remaining funds (Release #6-Final) from the escrow fund for Hanover Hills, Inc. (70-78 Norristown Road). The remaining balance is $21,667.16 plus accrued interest. A motion was made by Mr. Zucker, duly seconded by Mr. Young, and unanimously approved to authorize the Chairman and Secretary to sign on behalf of the Township a Pillar Agreement with Gregory S. Marx And Laurie Singer-Marx, owners of 215 LePont Circle. This agreement will permit the installation of a fence within the ultimate right-of-way of LePont Circle and within the limits of a sanitary sewer easement, on the condition that the fence will be removed if any future road widening, repair or excavation is necessary. A motion was made by Mr. Zucker, duly seconded by Mr. McKernan, and unanimously passed to authorize the Chairman and Secretary to sign on behalf of the Township a Pillar Agreement with Steven R. and Nancy W. Vignau, owners of 1029 Stony Brook Drive. This agreement will permit the installation of a fence within the ultimate right-of-way of Stony Brook Drive, on the condition that the fence will be removed if any future road widening, repair or excavation is necessary. A motion was made by Mr. Greco, duly seconded by Mr. McKernan, and unanimously passed to authorize the Chairman and Secretary to sign on behalf of the Township a Pillar Agreement with Frank D. and Nicole M. Kyvernitis, owners of 1501 Pulaski Drive. This agreement will permit the installation of a fence within the ultimate right-of-way of Yost Road, on the condition that the fence will be removed if any future road widening, repair or excavation is necessary. A motion was made by Mr. Zucker, duly seconded by Mr. Greco, and unanimously passed to adopt Resolution No. 849 a Resolution fixing fees for building permits, plumbing permits, mechanical permits, Zoning Hearing Board fees, Zoning fees, Conditional Use Hearing fees, Zoning Ordinance Amendment Application fees, Rezoning Application fees, Subdivision and Land Development plan review and submission fees, Sanitary permits and connection fees, Municipal pre-treatment fees, and miscellaneous fees pursuant to permit requirements established under the Codes of the Township of Whitpain. Chairman Palmer then called for any comments or questions from the Board. There were none. He then called for any comments or questions from the public. Mr. Jack Vogel explained that he is the president of the Normandy Farms Estates Community Information Committee, and he detailed the expansion project that is currently underway at that location. Due to the construction, which is anticipated to be approximately 18 months in duration, a large annual bazaar would not be feasible. Instead, the residents of that community would like to have a series of several smaller events spread out over that time period, and they needed the Township's permission for the display of a banner. Mr. Vogel added the proceeds from these events are used for educational and recreational programs for the residents of Normandy Farms. Additionally, Mr. Vogel asked for an explanation of the Pillar Agreements that were on the agenda. Mr. Pronczak stated that the agreements give Whitpain Township the right to remove the fences that were situated in the right-of-way for maintenance if necessary. Mr. Pronczak also provided an update as to the status of the road improvement projects that are due to take place within the Township. With no further business to come before the
