Work Session #3 - 2008

A Work Session of the Whitpain Township Board of Supervisors was held on Tuesday, February 5, 2008 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA at 7:30 PM for the purpose of reviewing the agenda of the February 5, 2008 Supervisors' Meeting. Vice-Chairman Brian W. Young was present with Supervisors Anthony F. Greco, William L. McKernan III, and Adam D. Zucker. Township Solicitor James J. Garrity, Esq., Township Manager Phyllis C. Lieberman, Assistant Township Manager/Township Engineer Roman M. Pronczak, Director of Finance M. Elizabeth McBride, Police Chief Mark A. Smith, Director of Public Works Ronald J. Cione, Director of Code Enforcement Michael E. McAndrew, Fire Marshal David M. Camarda, and Parks and Recreation Director Kurt W. Baker were also present. Two residents and a reporter were present. Chairman Joseph J. Palmer was absent.

The Supervisors reviewed the agenda discussing approval of the minutes of the January 22, 2008 Supervisors' Meeting, approval of the January 2008 voucher list, award of the contracts for renovations to the main floor of the administration building, approval of a two lot subdivision at 300 Lewis Lane, release of final escrow for Foxcroft Phase IV, release of escrow for the Tall Oaks Subdivision, authorization to advertise a public hearing on a request to transfer a liquor license for the Broad Axe Tavern, and authorization to advertise proposed Ordinance No. 155-6 (Sewer Use Ordinance).

Mrs. Lieberman noted that a request had been received from the Scout Troop at St. Dunstan's Church for a sign indicating that the troop meets there. The Church has already used all of its permitted signage. The Supervisors agreed that it was a worthy organization, but that there will be additional requests from other troops. After further discussion, the Supervisors asked Mrs. Lieberman to poll other townships to see how they handle it.

Mrs. Lieberman then noted that the citizen group wishing to use our meeting rooms for a discussion of the BoRit site had found another place to meet. The discussion had previously occurred about charging for use of the meeting rooms. Mrs. Lieberman noted that because of limited space the rooms are mostly used by Boards and Commissions, WRA, WRO, and political parties and that there really was no need to charge for use of the facility. The Board agreed.

The Supervisors then discussed a legal matter, Wissahickon Park.

The Supervisors then left for the public meeting.

At approximately 8:20 PM the Work Session was reconvened.

The Supervisors discussed another legal matter, Wings Field.

At approximately 9:30 PM the Work session was adjourned.

#3 - 2008

The regular monthly meeting of the Whitpain Township Board of Supervisors was held Tuesday, February 5, 2008 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA. Supervisors Brian W. Young, Anthony F. Greco, William F. McKernan, III, and Adam D. Zucker were present. Township Manager, Phyllis C. Lieberman, Township Engineer/Assistant Township Manager, Roman M. Pronczak, Township Solicitor, James J. Garrity, Director of Finance, M. Elizabeth McBride, Police Chief Mark A. Smith, Code Enforcement Officer Michael E. McAndrew, Public Works Director Ronald J. Cione, Fire Marshal David M. Camarda and Recording Secretary Virginia Papale were also present. Chairman Joseph J. Palmer and Park and Recreation Director, Kurt W. Baker were absent. There were approximately five members of the public in attendance.

Following the Pledge of Allegiance, the meeting was called to order by Vice-Chairman Brian Young at 8:01 p.m.

A motion was made by Mr. McKernan, duly seconded by Mr. Greco and unanimously passed approve the minutes of the January 22, 2008 Supervisors' Meeting.

A motion was made by Mr. Greco, duly seconded by Mr. McKernan and unanimously passed to approve all expenditures on the January, 2008 voucher list.

A motion was made by Mr. Greco, duly seconded by Mr. McKernan and unanimously passed to award contracts for renovations to the main floor of the administration building as follows: general construction to Centre Point Contracting, Inc. of Lansdale, PA in the low bid amount of $75,600; electrical to L.P. Herman Company of Ambler, PA in the low bid amount of $30,800.

A motion was made by Mr. Greco, duly seconded by Mr. Zucker and unanimously passed to approve a two-lot subdivision plan titled "Subdivision Plan - 300 Lewis Lane - Prepared for Michael Scully - Sheets 1 of 1", prepared by Chambers Associates, Inc., dated August 8, 2007, and last revised December 19, 2007, conditioned upon receipt of planning module approval from the Pennsylvania Department of Environmental Protection.

A motion was made by Mr. Greco, duly seconded by Mr. McKernan and unanimously passed to authorize final release of all remaining escrow funds held for the Foxcroft Phase IV development.

A confirming motion was made by Mr. Greco, duly seconded by Mr. McKernan and unanimously passed to release $7,425.00 (Release #1) from the escrow fund for the Tall Oaks Subdivision (S-7-03), located at 613 Cathcart Road.

A motion was made by Mr. McKernan, duly seconded by Mr. Zucker and unanimously passed to authorize the Township Manager to advertise a public hearing on February 19, 2008 to consider a request from Broad Axe Partners, Inc., which intends to operate the Broad Axe Tavern at 901 Butler Pike, Blue Bell, PA 19422, for approval to transfer Pennsylvania Liquor Control Board Restaurant License R-10090 from R.S.R. Sandy Hill, Inc., T-A ROCCO's Brick Oven Pizza, 1339 Sandy Hill Road, Norristown, PA 19401-4155.

A motion was made by Mr. Greco, duly seconded by Mr. McKernan and unanimously passed to authorize the Township Manager to advertise Ordinance #155-6, an Ordinance amending the Code of the Township of Whitpain, Part II (General Legislation), Chapter 122 (Sewers and Sewage), Part 2 (Sewer Service by East Norriton-Plymouth-Whitpain Joint Sewer Wastewater Collection System) by deleting Articles VII through XV in their entirety (inclusive of Sections 122-28 through 122-73) and replace the Articles VII through XV and Sections 122-28 through 122-73 with updated requirements setting forth the uniform requirements for direct and indirect contributions into the wastewater collection system including general provisions; general sewer use requirements; regulations; pretreatment of wastewater; wastewater discharge permit application procedures; administration and permit process and confidential information and publication procedures.

A motion was made by Mr. McKernan, duly seconded by Mr. Greco and unanimously passed to waive the traffic impact fees for the expansion at St. Helena's Church, due to the unique circumstances of the project.

Vice-Chairman Young then called for any comments or questions from the Board. There were none.

He then asked for comments from the public on old or new business. There were none.

With no further business to come before the Board, Vice-Chairman Young adjourned the meeting at 8:07 p.m.
