Work Session #3 - 2007 A Work Session of the Whitpain Township Board of Supervisors was held on Tuesday, February 6, 2007 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA at 7:30 PM for the purpose of reviewing the agenda of the February 6, 2007 Supervisors' Meeting. Chairman Leigh P. Narducci was present with Supervisors Anthony F. Greco, Brian W. Young, and William L. McKernan III. James Garrity from the Township Solicitor's office, Township Manager Phyllis C. Lieberman, Assistant Township Manager/Township Engineer Roman M. Pronczak, Director of Finance M. Elizabeth McBride, Chief Mark A. Smith, Director of Public Works Ronald J. Cione, Director of Code Enforcement Michael E. McAndrew, Fire Marshal David M. Camarda, and Parks and Recreation Director Kurt W. Baker were also present. One resident and one reporter were present. Supervisor Joseph J. Palmer was absent. The Supervisors reviewed the agenda discussing approval of the minutes of the January 16, 2007 Supervisors' Meeting, approval of the expenditures on the January, 2007 Voucher List, authorization to piggyback the PA General Services Contract Program and the PA Capital Cities Contract Program for the calendar year 2007, authorization to piggyback the Montgomery County Consortium of Communities and/or any individual Consortium municipality for the purchase of materials and supplies they bid in 2007, approval of Change Order No. 1 for needed changes to the current basement renovations project, a motion to sign an agreement between the Board of Supervisors and Franklin Realty Development Corporation for determination of the floodplain boundary at 1448, 1462, & 1486 Skippack Pike the Centre Square Hotel Property, approval to allow the Rotary Club of Blue Bell place two signs, one at the intersection of Skippack Pike and DeKalb Pike and the other in front of the Wissahickon Valley Public Library announcing the annual Wellness Expo, a confirming motion authorizing an agreement between Whitpain Township and Officer Georgette Jacob to provide animal control services for the Township, authorization to advertise a public hearing to consider a request from B.A.B.A.T., Inc. which intends to operate the Broad Axe Tavern for approval to transfer a Pennsylvania Liquor Control Board Restaurant License R-9326 form 131 Riverside, Inc., 131 Haws Avenue , Norristown, PA 19401, approval of a lease agreement between Whitpain Township and the Ambler-Whitpain Football Association pertaining to a well drilled at the stony Creek Sports Park and the land in its Vicinity, authorization to advertise proposed Ordinance No. 304 authorizing the participation of Whitpain Township in the Delaware Valley Health insurance trust pursuant to the Pennsylvania Intergovernmental Cooperation Law, and several Zoning Hearing Board applications. Mrs. Lieberman noted that a meeting needed to be scheduled with the Township's environmental attorneys regarding Wissahickon Park. The Supervisors asked that she send an e-mail to them with possible dates and they would get back to her. Mr. Pronczak then discussed the new bus route being used at Montgomery County Community College. He explained that during the reconfiguration of the Morris Road entrance/exit, busses have used the Cathcart Road entrance/exit. SEPTA wants to continue to use that route because the new configuration on Morris Road is not conducive for the busses making turns. In order to make this permanent, SEPTA must hold a public hearing. Mr. Jaskowiak, the resident attending the meeting said that he lives on Beechnut Drive and that he and many of his neighbors do not want the busses on Cathcart Road. There was further discussion about the routes the busses were taking and possible alternative routes. Mr. Jaskowiak stated that he had a petition signed by his neighbors opposing the Cathcart Road and that he would deliver it to the Township Building the next day. The Supervisors agreed that Cathcart Road should not be used. Mr. Pronczak said that he would meet with representatives from SEPTA and the College to look into alternative routes. The Supervisors then discussed two personnel matters. The Supervisors then left for the public meeting. At approximately 8:15 PM the Work Session was reconvened. The Supervisors discussed another personnel matter and two legal matters. At approximately 8:30 PM the Work Session was adjourned. Phyllis C. Lieberman #3 - 2007 The regular meeting of the Whitpain Township Board of Supervisors was held on Tuesday, February 6, 2007 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA. Supervisors Leigh P. Narducci, Brian W. Young, Anthony F. Greco, and William McKernan, III were present. Township Manager Phyllis C. Lieberman, Assistant Township Solicitor Joseph Bagley, Township Engineer/Assistant Township Manager Roman Pronczak, Finance Director Betsy McBride, Director of Public Works, Ronald J. Cione, Chief Mark Smith from the Police Department, Fire Marshal David M. Camarda, Code Enforcement Officer Michael E. McAndrew, Park and Recreation Director, Kurt W. Baker, and Recording Secretary Michele Alifano were also present. Supervisor Joseph J. Palmer and Township Solicitor J. Peirce Anderson were absent. There were approximately 15 members of the public in attendance. Following the Pledge of Allegiance, Chairman Narducci called the meeting to order. A motion was made by Mr. Young, duly seconded by Mr. Greco, and unanimously passed to approve the minutes of the January 16, 2007 Supervisor's Meeting. A confirming motion was made by Mr. Greco, duly seconded by Mr. McKernan, and unanimously passed to approve all expenditures on the January, 2007 voucher list. A motion was made by Mr. Young, duly seconded by Mr. Greco, and unanimously passed to authorize Whitpain Township to piggyback the PA General Services Contract Program and the PA Capital Cities Contract Program for the calendar year 2007. This will include the purchase of highway materials, vehicles and supplies, as needed. A motion was made by Mr. Greco, duly seconded by Mr. McKernan, and unanimously passed to authorize Whitpain Township to piggyback the Montgomery County Consortium of Communities and/or any individual Consortium municipality for the purchase of materials and supplies they bid in 2007. This motion will allow the same communities to piggyback our bids in 2007. A motion was made by Mr. McKernan, duly seconded by Mr. Young, and unanimously passed to approve Change Order No. 1 in the amount of $8,030 for needed changes to the current basement renovations contract. This amount includes $3,200 for shot blasting the basement floor, $2,970 for insulation to outside walls in accordance with the energy code, and $1,860 for 4' high fiberglass protective panels around the fitness area. A motion was made by Mr. Greco, duly seconded by Mr. Young, and unanimously passed to sign an agreement between the Board of Supervisors and Franklin Realty Development Corporation for determination of the floodplain boundary at 1448, 1462, & 1486 Skippack Pike, Center Square Hotel property. A motion was made by Mr. Young, duly seconded by Mr. Greco, and unanimously passed to approve a request from the Blue Bell Rotary Club to allow the placement of (2) signs, one at the intersection of Skippack & DeKalb Pikes, and the other in front of the Wissahickon Valley Public Library announcing the annual Wellness Expo. The signs would be displayed from April 10, 2007 through April 27, 2007. A confirming motion was made by Mr. Greco,
duly seconded by Mr. McKernan, and unanimously passed to authorize an agreement
between Whitpain Township and Officer Georgette Jacob to provide animal control
services for the Township. A motion was made by Mr. Greco, duly seconded by Mr. McKernan, and unanimously passed to approve a lease agreement between Whitpain Township and the Ambler-Whitpain Football Association. This agreement pertains to the well drilled at the Stony Creek Sports Park and the land in its vicinity. A motion was made by Mr. Greco, duly seconded by Mr. McKernan, and unanimously approved to authorize the Township Manager to advertise Ordinance #304, an Ordinance authorizing the participation of Whitpain Township in the Delaware Valley Health Insurance Trust pursuant to the Pennsylvania Intergovernmental Cooperation Law. The Board of Supervisors took no action
regarding the following applications to the Zoning Hearing Board:
The zoning classification of the subject property is "R-7" Residential District. NO: 1722-07: Application filed by Johnson S. Mulbah as owner of the property located at 215 Oak Street, Ambler, PA 19002, for variances from the terms of Article IX, Section 160-45.A, and Article XXV, Section 160-192 to allow for the construction of a non-conforming single detached residential dwelling expanded by the reconstruction of a 545.6 square foot addition reducing the minimum required front yard from 15' to 9.29' at the subject property. The zoning classification of the subject property is R-4 Village Preservation District. A motion was made by Mr. McKernan, duly seconded by Mr. Greco, and unanimously approved to authorize the Township Solicitor to appear on behalf of the Township in opposition of Zoning Hearing Board Application No. 1716-06, filed by T-Mobile Northeast, LLC, as a tenant of the property located at 792 DeKalb Pike, Blue Bell, PA. At this time, Chairman Narducci called for any old or new business to come before the Board. Mr. Greco commented that the Broad Axe intersection is making progress toward being restored, with Mr. Meitner making repairs to the old Broad Axe Tavern, and talks proceeding with the owners of the Sunoco property. Mr. Greco assured residents they would be seeing improvements in the near future. Chairman Narducci then took the opportunity to welcome back Township Manager, Mrs. Phyllis C. Lieberman, from her medical leave of absence, and commended Assistant Township Manager, Roman M. Pronczak, for a job well done as acting manager in Mrs. Lieberman's absence. Also, Chairman Narducci offered congratulations to Whitpain Township resident, Mr. William Polk, who was awarded the American Society of Civil Engineers Sections Presidential Award. Mr. Polk received his degree from the University of Wisconsin in 1937, and his career has spanned more than 40 years, with service in the public and private sectors. The majority of his career focused on transportation issues, with service as Executive Director & Chief Engineer of Passenger Service, which eventually became SEPTA, and Deputy Secretary for local and area transportation with the Pennsylvania Department of Transportation. There being no further business to come
before the Board, on motion made by Chairman Narducci, the meeting was
