Work Session #12 - 2007

A Work Session of the Whitpain Township Board of Supervisors was held on Tuesday, June 19, 2007 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA at 7:30 PM for the purpose of reviewing the agenda of the June 19, 2007 Supervisors' Meeting. Vice Chairman Joseph J. Palmer was present with Supervisors Brian W. Young, and Anthony F. Greco. Township Solicitor J. Peirce Anderson, Township Manager Phyllis C. Lieberman, Assistant Township Manager/Township Engineer Roman M. Pronczak, Chief Mark A. Smith, Director of Finance M .Elizabeth McBride, Director of Public Works Ronald J. Cione, Director of Code Enforcement Michael McAndrew, Fire Marshal David M. Camarda, and Parks and Recreation Director Kurt W. Baker were also present. Chairman Leigh P. Narducci and Supervisor William L. McKernan III were absent. There was one reporter present.

The Supervisors reviewed the agenda discussing the scheduling of Supervisors' Meetings in July and August, approval of the minutes of the June 5, 2007 meeting, authorization to advertise for bids for the Police sally port roll-up doors, authorization to advertise for landscaping and arborist services for 2007-2008, authorization to advertise for line painting services for 2007-2008, authorization to advertise for bids for minor wall modifications in the Township Building, a motion to release escrow for the Amberley at Blue Bell Apartment Project under certain conditions, authorization to advertise proposed Ordinance No. 4-222 adopting a new definition for metal containers for placement of clothing donation containers , recycle containers, and similar containers as a permitted use in the IN Institutional Zoning District, authorization to advertise proposed Ordinance No. 15-5 by repealing the current section 136-22 of the Code of Whitpain Township and replacing it with a defined penalty for realty transfer taxes unpaid when due, calculated at an interest rate of ten (10%) percent per annum and repealing all ordinances or portions of ordinances inconsistent therewith, and several Zoning Hearing Board applications.

Fire Marshal David Camarda then gave a brief report to the Supervisors on the Second Alarmers Ambulance. He noted that they have now been in the Township for six months and are officially recognized by the 911 service. As such, they will now be part of the Mutual Aid System. That means that when necessary, they might be sent to a surrounding municipality, as other companies come to us in similar circumstances. He also noted the deaths of nine firefighters in Charleston, NC and asked that something be said at the public meeting about their heroism and all those who perform that duty.

Mrs. Lieberman reported that the resident who wanted the Noise Ordinance amended because of work crews at an adjacent new development beginning at 6:00 AM on weekends had called again. The resident reported that they were still starting at 6:00. Mrs. Lieberman called the developer again and he said that he would address the situation.

The Supervisors discussed one legal matter.

The Supervisors then left for the public meeting.

The Work Session was reconvened only to sign documents.

#12 - 2007

The regular meeting of the Whitpain Township Board of Supervisors was held on Tuesday, June 19, 2007 at the Whitpain Township Building, 960 Wentz Road, Blue Bell, PA. Supervisors Joseph J. Palmer, Anthony F. Greco, and Brian W. Young were present. Township Manager Phyllis C. Lieberman, Township Engineer/Assistant Township Manager, Roman Pronczak, Township Solicitor, Peirce J. Anderson, Director of Finance, M. Elizabeth McBride, Code Enforcement Officer Michael E. McAndrew, Director of Public Works, Ronald J. Cione, Police Chief Mark A. Smith, Park and Recreation Director, Kurt W. Baker, Fire Marshal, David M. Camarda and Recording Secretary Michele Alifano were also present. Supervisors Leigh P. Narducci and William L. McKernan, III were absent. There were approximately 10 members of the public in attendance.

Following the Pledge of Allegiance, Vice Chairman Palmer called the meeting to order. Condolences were extended to the families and residents of the city of Charleston, NC, in recognition of the nine firefighters who lost their lives in a recent fire and subsequent building collapse. A moment of silence was observed.

Vice Chairman Palmer announced the dates for the upcoming regular Board of Supervisors' meetings which are scheduled for Tuesday, July 17, 2007 and Tuesday, August 7, 2007, both at 8:00 p.m.

A motion was made by Mr. Greco, duly seconded by Mr. Young, and unanimously passed to approve the minutes of the June 5, 2007 meeting.

A motion was made by Mr. Young, duly seconded by Mr. Greco, and unanimously passed motion to authorize the Township Manager to advertise for bids for the Police sally port roll-up doors.

A motion was made by Mr. Greco, duly seconded by Mr. Young, and unanimously passed to authorize the Township Manager to advertise for bids for landscaping and arborist services for 2007-2008.

A motion was made by Mr. Greco, duly seconded by Mr. Young, and unanimously passed to authorize the Township Manager to advertise for bids for road line painting services for 2007-2008.

A motion was made by Mr. Young, duly seconded by Mr. Greco, and unanimously passed to authorize the Township Manager to advertise for bids for minor wall modifications in the Township Building.

A motion was made by Mr. Greco, duly seconded by Mr. Young, and unanimously passed to release of $408,300.45 (Release #9) from the escrow fund for the Amberley at Blue Bell Apartment Project, conditioned upon receipt of a maintenance bond, as-built plans, and a certification of pins and monuments.

A motion was made by Mr. Greco, duly seconded by Mr. Young, and unanimously passed to authorize the Township Manager to advertise proposed Ordinance Number 4-222, an Ordinance amending Chapter 160 of The Code of the Township of Whitpain adopting a new definition for metal containers for placement of clothing donation containers, recycle containers, and similar metal containers as a permitted use within the I-Limited Industrial Zoning District.

A motion was made by Mr. Young, duly seconded by Mr. Greco, and unanimously passed to authorize the Township Manager to advertise proposed Ordinance No.15-5, an Ordinance amending Chapter 136, Article II, §136-22 of The Code of the Township of Whitpain, by repealing the current §136-22 and replacing it with a defined penalty for realty transfer taxes unpaid when due, calculated at an interest rate of ten (10%) percent per annum and repealing all Ordinances or portions of Ordinances inconsistent therewith.

The Board of Supervisors took no action regarding the following application to the Zoning Hearing Board:

NO: 1740-07: Application filed by Boehm's United Church of Christ with the permission of Skippack Land Partners, LP, the owner of 599 Skippack Pike, Blue Bell, PA, 19422 for variances from the terms of Article XXIII, Section 160- 181.B and Section 160-182.2.C to allow a 21 ½" x 45" double sided off-premises directional sign increasing the maximum sign area from 2 sq. ft. to 6.71 sq. ft at the subject property. The zoning classification of the subject property is "C" Commercial District..

NO: 1741-07: Application filed by T-Mobile Northeast, LLC as tenant of the property located at 945 Jolly Road for the following relief at the subject property:

1. A variance from the terms of Article XVI, Section 160-104 to allow the establishment of a telecommunications facility including a conduit insert of 168' to be attached to the existing PECO transmission tower with accompanying antennas and radio equipment cabinets.

2. A variance from the terms of Article XXV, Section 160-191.A and Section 160-191.B to allow the establishment of a telecommunications facility on the property consisting of a conduit insert of 168' to be attached to the existing PECO transmission tower with antennas attached thereto and increasing the maximum height of the communications tower from 50' to 172'.

The zoning classification of the subject property is "R-E" Research and Engineering District.

NO: 1742-07: Application filed by Charles Campagnucci with the permission of Salvatore Paone, the owner of the property located at 931 Butler Pike for a variance from the terms of Article XXIV, Section 160-183-B(2).(J) to reduce the minimum required parking spaces from 68 (required after the restaurant expansion) to 40 at the subject property. The zoning classification of the subject property is "C" Commercial District.

NO: 1743-07: Application filed by George D. O'Donnell as owner of the property located at 1431 Butler Pike for variances from the terms of Article X, Section 160-52, Article XXV, Section 160-192, and Article XXV, Section 160-193 to allow a shed to remain in the front and side yard (where the shed was located at the time of purchase) rather than in the rear yard as required at the subject property. The zoning classification of the subject property is "R5" Agricultural/Rural District.

Vice Chairman Palmer asked if any member of the Board had any comments. There were none. Mr. Palmer then asked if any member of the audience wished to address the Board. A representative was present for Zoning Hearing Board Case #1742-07. Mr Young explained that the Board had chosen to remain neutral on the case.

There being no further business to come before the Board, on motion made by Vice Chairman Palmer, the meeting was adjourned at 8:15 PM.
